Yes, dropshipping is legal in the US, the UK, the EU and most other markets. It is an ordinary fulfillment method: you sell a product, and your supplier ships it straight to the customer. What gets dropshippers into legal trouble is never the model itself.     When dropshipping becomes illegal<\/h2>\n\n\n\n

    Dropshipping turns into a legal problem in five situations.<\/p>\n\n\n\n

    Selling counterfeit or trademarked goods<\/h3>\n\n\n\n

    Cheap «designer» bags, knock-off earbuds with a famous logo and unlicensed fan merch are the fastest route to a lawsuit or a seized payment account. Brand owners file takedowns on marketplaces and on Shopify, and payment processors freeze funds for counterfeit sales. Sell generic or properly licensed products only.<\/p>\n\n\n\n

    Missing the shipping times you promise<\/h3>\n\n\n\n

    In the US, the FTC’s Mail Order Rule<\/a> applies to online stores. You need a reasonable basis for any shipping time you advertise. If you state no time, you must ship within 30 days. When you can’t ship on time, you must notify the customer and offer the choice to cancel for a full refund. A «5-day delivery» banner on items that take three weeks from a Chinese warehouse is exactly what this rule targets.<\/p>\n\n\n\n

    Fake reviews and misleading ads<\/h3>\n\n\n\n

    The FTC also bans fake reviews and testimonials, including reviews copied from a supplier’s listing and presented as your customers’ feedback. Before-and-after claims and health promises in ads fall under general truth-in-advertising law.<\/p>\n\n\n\n

    Skipping taxes and registration<\/h3>\n\n\n\n

    You owe income tax on dropshipping profit like any other business. In the US, sales tax depends on where you have nexus. Many states set economic nexus at $100,000 in annual sales, though thresholds vary. Amazon, eBay and Etsy collect and remit sales tax for you as marketplace facilitators. On your own Shopify store, collecting it is your job. An LLC is optional, but many cities and states require a general business license or a seller’s permit.<\/p>\n\n\n\n

    Ignoring consumer rights and product safety<\/h3>\n\n\n\n

    In the EU and the UK, online buyers can cancel within 14 days of delivery without giving a reason. That right applies to you as the seller, even if your supplier refuses returns. Some categories carry their own requirements: children’s products sold in the US need a Children’s Product Certificate, and electronics sold in the EU need CE marking.<\/p>\n\n\n
